This page contains the terms and conditions for purchasing from Mia&Mar. Please read the terms and conditions carefully before ordering any item. You should understand that by purchasing any of our products you agree to these terms and conditions.
By placing an order with Mia&Mar, you guarantee that you are at least 18 years old (or have an adult's permission to purchase from us) and accept these terms and conditions which apply to all orders placed or to be placed with Mia&Mar, for the sale or supply of any products. None of these terms and conditions affect your statutory rights. No other terms or changes to the terms and conditions shall be binding unless agreed to and signed by us.
By accepting these terms and conditions, you agree to the above.
Prices
1. We make every effort to ensure that the prices shown on our website are correct. However, we reserve the right to change them without prior notice.
Delivery
2. Average transit times are between 1 and 5 business days, depending on the destination (if you choose a pre-order item, this period will only begin after shipment). We are based in Portugal (Europe), and the customer is responsible for paying any duties, customs, charges or additional taxes imposed by the destination country for delivery. No customs fees will be applied to orders delivered to countries within the European Union.
Refused Shipments
3. If you choose to refuse your order, you will be responsible for any fees that the order may incur and the cost of shipping it to our address in Portugal. This amount will be deducted from the total refund of your order.
Customer Complaints
4. We make every effort to respond to all customer complaints or questions within a maximum of 5 business days.
Force Majeure
5. Events that occur outside of Mia&Mar's control and that are not predictable should be considered force majeure events, meaning that Mia&Mar is released from its obligations to comply with contractual agreements. An example of this type of event is a government action or omission, new or amended legislation, conflicts, embargoes, fire or floods, sabotage, accident, war, natural disasters, strikes, or lack of supply from suppliers. Force majeure also includes government decisions that negatively affect the market and products, for example, restrictions, warnings, prohibitions, etc. 6. All products remain the property of Mia&Mar until payment is made. The price applied is the one set on the date you placed the order. Shipping costs and fees will be available before confirming the purchase. If you are under 18, you must have the approval of an adult to purchase from Mia&Mar.
All transactions conducted through Mia&Mar are handled and processed by third parties dedicated to leak prevention to ensure your protection. Your card information is not stored, and all your card information is transmitted via SSL encryption. Please read the terms and conditions of your chosen payment method for the transaction, as they will be responsible for the transaction.
Local Fees
7. Please keep in mind that local fees (sales tax, customs duties) may apply, depending on your region and local customs regulations. These fees are the sole responsibility of the customer.
Exchanges and Returns
8. Mia&Mar wants you to have the best possible shopping experience. If the item does not meet your expectations, you may exchange or return it, according to the conditions below:
8.1. Deadline for Exchanges and Returns (online purchases)
The customer has a period of 14 calendar days after receiving the order to request an exchange or return of the item(s).
After this period, it will not be possible to make any exchange or return.
8.2. Item Conditions
Exchanges or returns will only be accepted if:
The item is in perfect condition, without signs of use, scratches or odors;
It is returned in its original packaging, including labels and accessories;
The invoice or proof of purchase is presented.
8.3. Excluded Items
Exchanges or returns are not accepted for:
Personalized or custom-made items;
Items on sale/out of stock
Items used or damaged due to mishandling (drops, contact with chemicals).
8.4. Procedure for Exchanges and Returns
To request an exchange or return, the customer must:
Fill out the form available on the website
Wait for confirmation and instructions from our team;
Send the item to the indicated address, with shipping costs borne by the customer,
8.5. Refund
After receiving and verifying the item, if the product meets the requirements for return, the refund will be processed within a maximum of 10 business days, using the same payment method used for the purchase.
8.6. Exchanges for purchases in physical stores/pop-ups
✔ Exchanges can be made up to 14 days after the purchase date, upon mandatory presentation of the invoice or proof of purchase, and provided that the item is in perfect condition, without signs of use, in the original packaging with the respective labels.
✔ There are no exchanges or returns of personalized items
✔ Returns are not made for items purchased in physical stores (pop-ups/showrooms).
✔ Piercings cannot be exchanged.
✔ Both exchanges and service requests must be made at the same place of purchase or at our showroom/headquarters.
Exchanges or service requests cannot be made between different pop-ups.
Warranty
9. Warranty
All items have a 2-year warranty, in accordance with current legislation, covering only manufacturing defects.
Presentation of the invoice or proof of purchase is mandatory for any service request.
The labels on the pieces must be carefully cut and never torn off, as forcibly removing them may damage the item. Any damage resulting from improper removal of the label will be considered misuse and, as such, is not covered by the warranty, nor eligible for exchange or repair.
To activate the warranty, the customer must:
Contact our team through the form available on the website, informing the order number and describing the problem;
Bring the item to our headquarters/showroom, in person or by mail.
After analysis, if the manufacturing defect is confirmed, the item will be repaired, replaced or refunded, as the case may be.
Damage resulting from misuse, drops, contact with chemicals and normal wear and tear of the part are not covered by the warranty.
* The request for assistance/warranty must be Performed at the same location as the purchase or in our showroom/headquarters.
Service requests cannot be made between different pop-ups.
Fraud
10. Mia&Mar reserves the right to cancel and refund any order suspected of fraud in order to guarantee the security of our consumers' transactions through our online services.
Mia&Mar reserves the right to resort to all solutions provided by law to deal with any violation or disrespect of these Terms and Conditions, including the right to block access to the website/or forward information about transactions to the authorities or payment providers. Individuals who violate the restriction of password-protected areas on the site may be subject to legal action.

Under Decree-Law No. 24/2014, of February 14, applicable to distance contracts, you have the right to freely terminate a new contract, without giving a reason, within 14 calendar days from the date of the order. If you wish, you can download, fill out, and send the sample form we provide below via email or mail.
If you cancel the order and return it within the above-mentioned period, your payment will be refunded using the same method you used to pay, no later than 14 days after we have received your communication and order.
Additional Information
13. Mia&Mar reserves the right to change any information, including prices, technical specifications, terms of purchase, and product offers without prior notice. If a product is out of stock, Mia&Mar has the right to cancel the order and refund the amount paid in the manner the customer wishes. Mia&Mar must also notify the customer if equivalent products are available.
